Terms of service.

The rules for this site, the dashboard and the text-message programme. If you are here for the text messages, the section describing the whole programme is further down.

Who we are

Nexod is a business established in Montréal, Québec. It designs and runs advertising campaigns, landing pages and evaluation tools for Quebec real-estate brokers, under the broker's own brand.

The broker holds their own licence and remains responsible for their OACIQ compliance. Nexod holds no brokerage licence, does not act as a broker, and certifies nothing on a broker's behalf.

The service

Who it is for
The service is sold to real-estate brokers. It is not offered to the general public and there is no self-serve signup: access is created by us, for a named broker.
What we operate
Campaigns, pages and creative are designed and published by us on the broker's behalf. The ad account and the budget stay theirs; we do not take their ad budget through us.
The leads belong to the broker
Requests collected belong to the broker whose campaign produced them. They are not resold, not shared with another broker, and not recycled into another campaign.
What stays ours
The pages, templates, creative and tools we build remain Nexod's property and are operated for the broker for the duration of the service.

Your dashboard access

It is personal
Your access is yours alone. Keep your password to yourself and tell us if you think someone else has used it.
What you see there
The dashboard is a read-only mirror: your campaigns, your leads and your figures. It carries no control that spends your budget.
Acceptable use
Do not try to reach another broker's data, bypass authentication, bulk-extract the content or degrade the service. Access can be suspended for any of those.

The text-message programme

This section describes exactly what the system does. It applies to anyone who ticked the text-message consent box on one of our forms, or on the form of a broker we operate.

Who sends
Nexod, on behalf of the real-estate broker named on the page where you filled in the form, from a Canadian number provided by Nexod. The message carries the broker's name and OACIQ licence number.
How you opt in
By ticking a separate box, never pre-ticked, when you submit the form. The text shown beside that box is recorded as it stood, with the date and the language. There is no other way in: we import no lists and we buy no numbers.
Consent is a condition of nothing
Consent to receive text messages is not a condition of any purchase, of access to the service, of getting your evaluation, or of hearing back from the broker. The form submits without the box and everything else works the same.
Which messages
Two kinds, and nothing else: an acknowledgement sent within minutes of your submission, and the broker's follow-up about that same request. No promotion for a third party, and no message that does not follow from your own request.
How often
Message frequency varies with your request, and it is capped by the system itself: at most four follow-up messages in any 30-day period, at most fourteen in total, never two on the same day on the same channel, and nothing between 21:00 and 09:00 Eastern.
Charges
Message and data rates may apply. They are charged by your mobile carrier, according to your plan, and are nothing to do with Nexod.
To opt out
Reply STOP at any time to stop receiving text messages. ARRET, ARRÊT, DESABONNER, DÉSABONNER, STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT do the same thing. Opt-out is immediate and permanent: it is written to the consent ledger, any running sequence is cancelled, and no send can work around it.
To get help
Reply HELP or AIDE to any message. You will get back who is writing to you, an address to reach us at, and the reminder that STOP opts you out. You can also write directly to ops@nexod.ca.
Delivery
We cannot guarantee that a message reaches you: delivery depends on your handset and your carrier, and neither is under our control.
What we do with your number
Your mobile number and your consent are never sold, rented, traded or shared with third parties for marketing or promotional purposes. The detail is in the privacy policy.

Emails

A confirmation email goes out when you fill in a form, and a follow-up may be sent afterwards by the broker about that request. Every email carries an unsubscribe link at the foot of it that works first time and without signing in.

An email unsubscribe also stops the other channels: we treat it as a withdrawal of consent for everything, not only for the email that carried the link.

What we do not promise

There are things we control and things we do not, and confusing the two would be selling you something false.

No volume guaranteed
We control the design, the checking and the publication. We control neither your market, nor your budget, nor the advertising platform, so we promise no number of leads, no sale and no return.
An estimate is not an appraisal
A range produced by an online tool is indicative. It is not a certified appraisal, it is not a broker's signed opinion of market value, and it must not be used as the basis of a transaction.
Interruptions
The service can be interrupted for maintenance or through a supplier's fault. We do not guarantee uninterrupted availability.
These terms can change
If they change, the effective date at the top of the page changes with them. A material change to the text-message programme would be announced to the people enrolled in it before taking effect.

Governing law

These terms are governed by the laws applicable in Québec, and the courts of the district of Montréal have jurisdiction over any dispute arising from them. Nothing here removes a consumer's rights under the law.
